Giustizia e processo – Notifica dei motivi aggiunti – Erronea individuazione della sede legale del notificatario già emersa nella relata di notifica del ricorso introduttivo – Scusabilità dell’errore e rimessione in termini – Esclusione – Conseguenze

Non è scusabile, nè può dar luogo a rimessione in termini ai
sensi dell’art.44 del c.p.a., l’errore del ricorrente che notifichi i motivi
aggiunti presso la sede legale della controinteressata indicata negli atti di
gara, nel caso in cui l’Ufficiale Giudiziario abbia già dato atto dell’avvenuto
trasferimento della società nella relata del ricorso introduttivo. Ciò in
quanto il notificante avrebbe potuto diligentemente
verificare il nuovo domicilio della società controinteressata, dopo l’esito
negativo della prima notifica.

ORDINANZA

sul ricorso numero di registro generale 938 del 2011, integrato da motivi aggiunti, proposto da Intini Angelo s.r.l., rappresentata e difesa dagli avv.ti Federico Massa e Francesco Cantobelli, con domicilio eletto presso l’avv. Pierluigi Balducci in Bari, via Melo, 114;

contro
Ferrovie Appulo Lucane s.r.l., rappresentata e difesa dall’avv. Pier Luigi Piselli, con domicilio eletto presso l’avv. Antonio Colaleo in Bari, via Principe Amedeo, 197;

nei confronti di
Salvatore Matarrese s.p.a., rappresentata e difesa dall’avv. Sabino Persichella, con domicilio eletto presso il suo studio in Bari, via Principe Amedeo, 197;

per l’annullamento
previa sospensione dell’efficacia,
dell’atto con cui la società resistente ha aggiudicato definitivamente alla Salvatore Matarrese s.p.a. l’appalto per la progettazione esecutiva ed esecuzione dei lavori di completamento della linea Bari – Bitritto con nuovo percorso tra S.Andrea e Bari Centrale;
per la dichiarazione di inefficacia del contratto e per il risarcimento in forma specifica ovvero per equivalente;
Visti il ricorso, i motivi aggiunti e i relativi allegati;
Visti gli atti di costituzione in giudizio di Ferrovie Appulo Lucane s.r.l. e di Salvatore Matarrese s.p.a.;
Vista la domanda di sospensione dell’esecuzione del provvedimento impugnato, presentata in via incidentale dalla parte ricorrente;
Visto l’art. 55 cod. proc. amm.;
Visti tutti gli atti della causa;
Ritenuta la propria giurisdizione e competenza;
Relatore nella camera di consiglio del giorno 21 settembre 2011 il dott. Savio Picone e uditi per le parti i difensori avv.ti Francesco Cantobelli, Francesco Vagnucci (per delega di Pier Luigi Piselli) e Sabino Persichella;

Ritenuto, nei limiti della sommaria cognizione propria della fase cautelare, che l’eccezione di inammissibilità sollevata dalle parti resistenti (per tardiva notifica del ricorso alla società aggiudicataria, controinteressata necessaria) appare prima facie meritevole di considerazione, in quanto:
– l’atto di motivi aggiunti è stato erroneamente notificato, in data 18 giugno 2011, allorquando la ricorrente aveva già constatato l’avvenuto trasferimento della sede legale della Salvatore Matarrese s.p.a. (risultante dalla relata di notifica del ricorso introduttivo, in data 29 aprile 2011);
– tanto fa ritenere che non vi siano, nella fattispecie, i presupposti per riconoscere l’errore scusabile e la rimessione nei termini, giacchè parte ricorrente avrebbe potuto diligentemente verificare il nuovo domicilio della società controinteressata, dopo l’esito negativo della prima notifica;
– per le stesse ragioni, non ricorrevano i presupposti per la concessione di un termine ai sensi dell’art. 44, ultimo comma, cod. proc. amm.;
Ritenuto, pertanto, che non sussistono le condizioni per l’accoglimento dell’istanza cautelare;
P.Q.M.
Il Tribunale Amministrativo Regionale per la Puglia (Sezione Prima) respinge la domanda di sospensiva.
Spese compensate.
La presente ordinanza sarà eseguita dall’Amministrazione ed è depositata presso la segreteria del tribunale che provvederà a darne comunicazione alle parti.
