1. La normativa regionale dichiarata incostituzionale con sentenza della Corte Costituzionale n. 344 del 26 novembre 2010, quale l’intero regolamento regionale n. 16 del 2006, unitamente all’art. 3, comma 16, della legge regionale n. 40 del 2007, non può più essere assunta quale parametro di legittimità dei provvedimenti emanati dalla Regione Puglia sull’assoggettamento a valutazione d’impatto ambientale di progetti aventi ad oggetto la realizzazione di parchi eolici.

2. In base alle norme vigenti in materia di impianti per la produzione di energia da fonti rinnovabili, non può riconoscersi una potestà dei Comuni di denegare il relativo nulla-osta ovvero di selezionare l’impresa titolata alla realizzazione degli impianti sul proprio territorio.

sul ricorso numero di registro generale 1513 del 2009, proposto dal Comune di Stornarella, rappresentato e difeso dall’avv. Domenico Ciccone, con domicilio eletto presso l’avv. Maurizio Di Cagno in Bari, via Nicolai, 43;

contro

Ritenuto e considerato in fatto e diritto quanto segue.

FATTO
Il Comune di Stornarella impugna i provvedimenti indicati in epigrafe, con i quali la Regione Puglia si è pronunciata sull’assoggettamento a valutazione d’impatto ambientale dei progetti presentati da Fortore Energia s.p.a., Daunia Wind s.r.l., Inergia s.p.a. e Sorgenia s.p.a., aventi ad oggetto la realizzazione di parchi eolici nel territorio comunale.
Deduce violazione degli artt. 8 e 14 del regolamento regionale n. 16 del 2006 ed eccesso di potere per difetto d’istruttoria ed illogicità .
Afferma, in sintesi, che la Regione avrebbe dovuto accordare priorità , nella valutazione sulla compatibilità ambientale dei progetti interferenti, all’istanza presentata da Inergia s.p.a., unica tra le imprese richiedenti ad aver sottoscritto (in data 28 marzo 2007) una convenzione con il Comune, sulla base di quanto disposto dall’art. 14 del regolamento regionale n. 16 del 2006.
La Regione, invece, avrebbe illegittimamente ignorato il titolo di preferenza vantato da Inergia s.p.a., procedendo ad una riduzione proporzionale degli aerogeneratori esenti da v.i.a. per tutte le imprese interessate.
Si è costituita la Regione Puglia, chiedendo il rigetto dell’impugnativa.
Le controinteressate Daunia Wind s.r.l. e Margherita s.r.l. (quest’ultima subentrata alla prima nella titolarità dell’autorizzazione n. 266 del 18 maggio 2009) hanno notificato ricorso incidentale, volto ad ottenere l’annullamento della convenzione stipulata il 28 marzo 2007 tra Inergia s.p.a. ed il Comune di Stornarella e della presupposta deliberazione del Consiglio comunale di Stornarella n. 5 del 22 febbraio 2007.
Si è altresì costituita Inergia s.p.a., aderendo alle censure svolte dal Comune ricorrente.
Le parti hanno svolto difese in vista della pubblica udienza del 18 maggio 2011, nella quale la causa è passata in decisione.
DIRITTO
Il Comune di Stornarella lamenta la violazione di plurime disposizioni del regolamento regionale n. 16 del 2006, affermando che la Regione Puglia avrebbe dovuto tener conto, in sede di verifica dell’assoggettabilità a v.i.a. di progetti per la realizzazione di parchi eolici nel territorio comunale, della convenzione onerosa stipulata tra lo stesso Comune ed Inergia s.p.a. in data 28 marzo 2008.
Il ricorso è infondato.
Come è noto, l’intero regolamento regionale n. 16 del 2006 è stato annullato dalla Corte costituzionale con la sentenza n. 344 del 26 novembre 2010, unitamente all’art. 3, comma 16, della legge regionale n. 40 del 2007, che a detto regolamento rinviava integralmente.
Dunque, anche nel presente giudizio la normativa regionale dichiarata incostituzionale non può più essere assunta quale parametro di legittimità dei provvedimenti impugnati.
L’impugnativa è, in ogni caso, infondata quanto all’asserito eccesso di potere per difetto d’istruttoria ed illogicità .
In disparte la sopravvenuta declaratoria di incostituzionalità che ha travolto l’intero regolamento regionale n. 16 del 2006, va ribadito in linea generale che non può riconoscersi, in base alle norme vigenti in materia di impianti per la produzione di energia da fonti rinnovabili, una potestà dei Comuni di denegare il relativo nulla-osta ovvero di selezionare l’impresa titolata alla realizzazione degli impianti sul proprio territorio (si rinvia, sul punto, ai numerosi precedenti di questa Sezione: per tutte, sentenze 8 marzo 2008 n. 530 e 24 settembre 2009 n. 2105).
La convenzione onerosa stipulata il 28 marzo 2007 dal Comune di Stornarella con Inergia s.p.a. non ha alcuna efficacia vincolante per le Amministrazioni che, a vario titolo, sono chiamate ad esprimersi in sede di valutazione d’impatto ambientale e nella conferenza di servizi preordinata al rilascio dell’autorizzazione unica, ai sensi dell’art. 12 del d. lgs. n. 387 del 2003 (in questo senso, su fattispecie identica: TAR Puglia, Bari, sez. I, 14 settembre 2010 n. 3470).
àˆ conseguentemente improcedibile, per difetto d’interesse, il ricorso incidentale proposto da Daunia Wind s.r.l. e Margherita s.r.l. avverso la convenzione stipulata tra Inergia s.p.a. ed il Comune di Stornarella e la presupposta deliberazione del Consiglio comunale di Stornarella n. 5 del 22 febbraio 2007.
Le spese di giudizio restano compensate nei confronti di Inergia s.p.a., che si è costituita ad adiuvandum, mentre seguono la soccombenza nei confronti della Regione Puglia, di Daunia Wind s.r.l. e Margherita s.r.l., nella misura forfetaria indicata in dispositivo.
P.Q.M.
il Tribunale amministrativo regionale per la Puglia (Sezione prima) definitivamente pronunciando sul ricorso, come in epigrafe proposto, lo respinge.
Dichiara improcedibile il ricorso incidentale.
Condanna il Comune di Stornarella al pagamento delle spese di giudizio in favore della Regione Puglia, nella misura di euro 2.000, ed in favore di Daunia Wind s.r.l. e Margherita s.r.l., nella misura complessiva di euro 2.000, il tutto maggiorato di i.v.a., c.a.p. ed accessori di legge, se dovuti. Compensa le spese di giudizio nei confronti di Inergia s.p.a.
Ordina che la presente sentenza sia eseguita dall’Autorità amministrativa.
